BRONX ZOO BROWN BEAR EVERYWHERE SWEEPSTAKES (the "Sweepstakes") starts at 3:00:01 pm (EST) on October 12, 2016 and ends at 2:59:59 pm (EST) on October 26, 2016. The sponsor of this Sweepstakes is the Wildlife Conservation Society ("Sponsor"), with a principal place of business at 2300 Southern Boulevard, Bronx, New York 10460. The Sweepstakes shall be subject to these Official Rules, and by entering, all participants agree to be bound by the terms and conditions herein. Certain restrictions may apply.
The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Facebook.
ELIGIBILITY: This Sweepstakes is open only to legal residents of the fifty United States (not including territories and possessions) and the District of Columbia who are at least 18 years of age as of date of entry. Employees, officers, directors, trustees, representatives or agents of Sponsor, Macmillan Publishers, or any of their respective affiliates, parent, and subsidiary companies, licensors, distributors, divisions and their advertising, production and promotion agencies (collectively, the "Sweepstakes Entities"), and the immediate families and those living in the same household of any of the above are not eligible to enter. All federal, state and local rules and regulations apply.
HOW TO ENTER: Beginning 3:00:01 pm (EST) October 12, 2016, you may enter by clicking the link on that day's Bronx Zoo Facebook post relating to "Brown Bear Everywhere" and completing the entry form. THE FORM MUST BE FILLED OUT AND SUBMITTED BY 2:59:59 PM (EST) ON October 26, 2016. ONLY ONE ENTRY PER PERSON, HOUSEHOLD AND/OR PER EMAIL ADDRESS WILL BE ACCEPTED.
The Sponsor, the Sweepstakes Entities, Facebook and any and all Internet server(s) and access provider(s) are not responsible for: any incorrect or inaccurate entry information; human errors; technical malfunctions; failures, omissions, interruptions, deletions or defects of any telephone, broadband, wireless or other network, computer online system, computer equipment, server, provider, or software, including without limitation any injury or damage to participant's or any other person's computer relating to or resulting from participation in the Sweepstakes; inability to access an entry site or any web page thereof; theft, tampering, destruction, or alteration of, or unauthorized access to, entries; data that is processed late or incorrectly or that is incomplete or lost due to computer or electronic malfunction or traffic congestion on transmission lines or the Internet or any web site (including the entry site) or for any other reason whatsoever; typographical, printing or other errors; or any combination thereof. NOTE: Internet entry must be made by the entrant, only at an entry site. Entries made by any other individual or any entity, and/or originating at any other website or email address, including but not limited to commercial sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for this Sweepstakes. The use of any device to automate the entry process is prohibited.
Proof of having entered information at an entry site is not considered proof of delivery or receipt. Illegible, incomplete, and duplicate entries will be disqualified. All entries become the property of the Sponsor and will not be acknowledged or returned. False, fraudulent or deceptive entries or acts shall render entrants ineligible.
PRIZES: Three (3) Brown Bear-branded prize packs, including a family four-pack (4) of Bronx Zoo Total Experience tickets (two (2) adults and two (2) children); one (1) parking pass for Bronx Zoo; a family pass to the Eric Carle Museum in Amherst, MA (for up to two (2) adults and four (4) children); Brown Bear & Friends four (4) Board Book Gift Set; Brown Bear Anniversary tote bag; and a Brown Bear Anniversary print. Each prize pack is valued at $206.30.
WINNER SELECTION: Three (3) winners will be selected in a random drawing from among eligible entries on or about October 26, 2016 after the close of the entry period, by Sponsor, whose decisions are final in all matters relating to this Sweepstakes. Winner(s) will be notified within the October 12 Facebook post's comments and by email by October 27, 2016 and must respond no later than October 30 at 3:00pm EST if they intend to claim the prize. Winners must provide a mailing address to Sponsor. Winners can either pick the prize up at the Bronx Zoo, or the Sponsor will mail the prize on or around November 1, 2016. Winner will be required to execute and return an Affidavit of Eligibility/ Release of Liability/Prize Acceptance form and a completed IRS W-9 form. If a prize notification or prize is returned to Sponsor as undeliverable for any reason, prize will be awarded to an alternate winner. At Sponsor's sole discretion, a prize of equal or greater value may be substituted for any prize that becomes unavailable for any reason. Winners may not themselves make prize substitutions. Prizes are not transferable or redeemable for cash.
Any applicable federal and state tax liabilities are the sole responsibility of the winners. Acceptance of a prize constitutes permission (except where prohibited) for the Sweepstakes Entities to use winner's name, address (city and state), likeness and statements for publicity purposes without additional compensation.
Odds of winning depend on number of eligible entries received.
LIMITATION OF LIABILITY: Sponsor, the Sweepstakes Entities and Facebookshall not be liable to winners or any other persons for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, epidemic or pandemic, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot or any other cause beyond Sponsor's reasonable control. Sponsor is not responsible for any typographical or other errors in the written announcement or posting of information relating to the Sweepstakes.
GENERAL: Entrants agree to release and waive any claims they may have against Sponsor, the Sweepstakes Entities and/or Facebook for any and all injuries, claims, damages, losses, costs, or expenses of any kind (including without limitation attorney's fees) resulting from acceptance, use, or misuse of any prize or element thereof, or participation in this Sweepstakes. By entering the Sweepstakes, entrants affirm that they have read and accepted these Official Rules. The Sweepstakes shall be governed by and construed in accordance with the laws of the State of New York. By entering the Sweepstakes, entrants hereby submit to the jurisdiction and venue of the federal and state courts of New York and waive the right to have disputes arising out of the subject matter hereof adjudicated in any other forum.
If for any reason it is not possible to operate this Sweepstakes as planned, or if this Sweepstakes or any web site associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of the Sweepstakes and processing of entries in accordance with these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in the Sponsor's sole opinion, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify, or suspend this Sweepstakes or any portion thereof.
In the event this Sweepstakes is cancelled, the Sponsor will conduct a random drawing to award the prize from among all eligible, non-suspect entries received prior to the time of the action or event warranting such cancellation. If such cancellation, termination, modification, or suspension occurs, notification will be posted at the entry sites. If a dispute arises about who submitted an entry on an entry site, the entry will be deemed submitted by the authorized account holder of the email account entered. The authorized account holder is deemed the natural person who is assigned to an email address by an Internet access provider, service provider, or other online organization with such responsibility. A potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the winning entry and that all eligibility requirements are met.
Notwithstanding the foregoing, the Sponsor reserves the right, in it sole discretion, to cancel or modify the Sweepstakes for any reason or no reason.
